H1B portability - 2010/01/12 09:44 Hello,

I am currently in US on H1-B. My wife ( currently in India) was counted against the 2002 H1b quota. She was granted the same for 3 years. So her H1B permit expired in 2005.

She used a year out of this in 2003. Since then, she has not been to US or applied for H1. I would like to ask the following:
1. Her present company in India is willing to file her H1_b petition. will her petition be counted as cap-exempt ?
2. Can we reclaim 5 years on her expired H1?
3. If the answers are yes , can you please provide us the USCIS law reference ( either Section or addendum), which can act as documentary evidence to prove our case as the company will accept our H1B filing request only if this evidence is provided.
