- Complexity of US Immigration Law PDF Print E-mail

Immigration Law is a very complex area of law. The laws and the regulations are constantly changing. Keeping up with the changes requires dexterity.  Therefore, you need to carefully pick your attorney.  It is imperative that you are represented by a licensed attorney. A licensed attorney is bound by the rules of professional responsibility and therefore is more likely to take responsibility for his/her actions. There many so called "consultants" out there. The truth is that unless they are permitted to repsent you by the Board of Immigration Appeals(BIA), they are not allowed to give legal advice. Many are actually practising law without a license which is a crime. Moreover, they will frequently take advantage of immigrants. Many consultants represent themselves as attorneys.  Because they are not attorneys, they lack the necessary legal knowledge to assist you in your immigration cases. Again, remember that immigration law is highly specialized area of practice. We have gathered few authoritative quotes below:

Those quotes  confirm the complexity of Immigration Law and why it is important to have the assistance of an experienced licensed attorney to help in your case:

1. In Lok v. INS, the 2nd Circuit noted that "Immigration laws bear a "striking resemblance ...[to] King Minos's labyrinth in ancient Crete. The Tax Laws and the Immigration and Nationality Acts are examples we have cited of Congress's ingenuity in passing statutes certain to accelerate the aging process of judges."

2. E. Hull, Without Justice For All 107 (1985) - "With only a small degree of hyperbole, the immigration laws have been termed 'second only to the Internal Revenue Code in complexity.' A lawyer is often the only person who could thread the labyrinth.".

3. In the case of Castro-O'Ryan v. INS, the 9th Circuit Court stated - "Immigration law is very complex."

4. In 2003, the Second Circuit Court of Appeal, in Drax v. Reno noted that -"This case vividly illustrates the labyrinthine character of modern immigration law-a maze of hyper-technical statutes and regulations that engender waste, delay, and confusion for the Government and petitioners alike. The inscrutability of the current immigration law system, and the interplay of the numerous amendments and alterations to that system by Congress during the pendency of this case, have spawned years of litigation, generated two separate opinions by the District Court, and consumed significant resources of this Court. With regret and astonishment, we determine, as explained more fully below, that this case still cannot be decided definitively but must be remanded to the District Court, and then to the Board of Immigration Appeals ("BIA"), for further proceedings."

5. Karen Kraushaar from Citizenship and Immigration Services : "Immigration law is a mystery and a mastery of obfuscation, and the lawyers who can figure it out are worth their weight in gold."

We are convinced that each client needs quality representation.   Indeed, such representation can only come from a licensed member of the State Bar.
