November 16 2015 – After the tragedy of November 13, 2015 in Paris, many states have stated they will not actually accept any refugees from Syria in their States. As expected and as stated in our article, Paris Attacks and The Immigration Impact – Immigrants Know Your Rights!”, those States are well-known to be anti-immigrantion and any opportunity to fuel the “immigrantphobia” are always welcome. The question is how legal is this?

Immigration is under federal laws, and as such once the Department of Homeland Security (DHS) makes a rule, the states have to comply. However, under the 10th Amendment, the States have certain police powers and as such claim that they have a right to protect their citizens. The truth is that unless we see a lawsuit and the court decides on the matter, we believe no State has the right to make their own immigration law.

Now we will be awaiting on how the US government react. In the past, many of the same States have actually been fighting the Obama Administration when it comes to immigration. One of their biggest victory has actually been the blocking of DAPA laws. The question is whether it will be the same for refugees laws based on rules actually ratified by UN conventions.

While only one of the alleged attackers was seen with a so-called Syrian passport, most of the members who conducted the Paris attack were French nationals or French citizens. The question is whether millions of people need to be punished for the action of few deranged individuals? If that is the case then I think we should rethink our way of life!
