U Visa: Data Set: Form I-918 Application for U Nonimmigrant Status

uvisaprocessingU visa is the visa that is offered for those who are victims of certain crimes. However, the U visa has one limitation which is the cap to 10,000 per year and many people who have filed in the past 2 years have been stuck on this track. When the U visa first started really being processed around 2007 and 2008, it was taking only few months for the Employment Authorization Documents to be issued.  Later it was taking one year, recently due to the increase in number of applicantion, we are seeing a surge in applications. Unfortunately unlike the other visas, like EB, or family the U visa is not controlled by the visa bulletin and as such it becomes a headache to really know when the applicant will receive an EAD after filing their form I-918.  However the USCIS periodically releases a U visa processing time 2016 chart on a quarterly basis and the latest one was released on March 21 2016.  This is known as the I918 Data Set Form Application for U Non Immigrant 

As per this U visa processing time 2016 chart we are seeing around 107,000 pending U visas from the USCIS.  As such, based on the calculations from our office cases and looking  at our clients’ cases which have pending U visa cases, our calculations is around 2 years for processing at this point in time. We are expecting that this will be increased to 2.5 to 3 years of waiting by next year unless the government adds more on the quota.
