Recently many have been asking which employer to choose to file for their H1B visa.  Either you are on an H4 visa or an OPT, the choice is important because it might mean the ability to stay and work in the United States. As such we have tried to compile few tips on on how to choose for the “right employer”. Note that the following is provided for educational purposes only, you should not solely rely on the information to make a decision. Nonetheless the information can be very helpful:

  1. Pick an E-Verify employer because it will be a headache for someone to deal with a non-E Verify company.
  2. Read about the employer on websites such as MyVisaJobs.com or about the reviews on the employer. If you see repetitive abuses by the employer, we recommend you stay away from such an employer.
  3. Check about the number of H1Bs filed through the number of Labor Conditions Applications (LCA) filed and approved.
  4. Check if they are direct employers or consulting companies. If they are consulting companies check if they have serious end clients or just misrepresenting to you.
  5. Avoid any employer who wants to inflate your resume.
  6. Do not pay any fees for the H1B application, the employer is supposed to pay for this.
  7. Make sure the H1B employer is compliant such as having a real office, has not been sued by any employee, is using an actual lawyer to prepare your case,  that you will have access to your documents on time like your LCA, your approval notices, etc.

  9. Check if the employer will actually file for your permanent residence (Green Card) and in how much time they will start your labor certification process and your I-140 petition.
  10. Try your best to find out whether the company is under investigation for fraud. If this is the case, then stay away from such a company.
  11. Do not sign any contract where there is an unreasonable penalty clause in the contract.
