US Citizenship Case Delayed after the interview.
Caller: I Have a question regarding US Citizenship , I had my Dec 6 and I have been waiting for the Oath Ceremony I just wanted to find out if expected wait or something else going on?
A: Well this is how it works the rule requires you to wait, you pass the test right?
Caller: Yeah
A: So the rule is 120 days, depending on where you did it? Did you do it in San Jose or SFO?
Caller: San Jose
A: Yes there is a little bit delay because of the New Year, unless there is some problems in your case, but usually wait 60 days you should get it , if you don’t get it after 60 days you can always make a call, but you cannot really do much until 120days have passed so If I were I would a little bit more and then if nothing is happening after 60days call them on the 800 number and if still there are problem after120days you can give us a call we might be able to help, there is a way to unclog this case with a lawsuit under the 1447b but its not recommended at this point its too early
Caller: So once the interview is done they do some other process or some check or something?
A: Yes they can, it all depends on the officer, if he has miss something in your background or they think that you lied or they think that you made a mistake or they don’t think you deserve citizenship or you overstayed outside so they are going to do a check by the supervisor if everything is clear then they issue the Oath date and lately because of the New Year and Christmas things have been delayed a little bit, I would imagine by the end of this month or beginning of next month you should get your oath date ok if there is no problem.
